A. Right of Withdrawal
Introduction
Consumers have a right of withdrawal under the following provisions, where a consumer is any natural person who enters into a legal transaction for purposes that are predominantly attributable neither to their commercial nor to their independent professional activity:
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire fourteen days from the day on which you or a third party named by you, who is not the carrier, acquired physical possession of the last goods.
To exercise your right of withdrawal, you must inform us (Aysen Babalik, Élysée Diamonds, Verbrüderungsring 12H, 21493 Schwarzenbek, Germany, Tel.: +4915259427678, Email: support@elysee-diamonds.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, although it is not obligatory.
You may also exercise your right of withdrawal online on our website at https://elysee-diamonds.com/pages/vertrag-widerrufen. If you use this online option, we will send you an acknowledgement of receipt of such a withdrawal without delay on a durable medium (e.g. by email), including information on the content of the withdrawal declaration and the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we received notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement. We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired.
You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion or Early Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or that are clearly tailored to the personal needs of the consumer.
Linked/Financed Transactions
If you finance this contract through a loan and later withdraw from it, you are also no longer bound by the loan agreement, provided the two contracts form an economic unit. This is in particular presumed if we are simultaneously your lender or if your lender makes use of our cooperation with regard to the financing. If the loan has already been paid out to us at the time the withdrawal or return takes effect, your lender assumes, in relation to you, our rights and obligations under the financed contract with regard to the legal consequences of the withdrawal or return. The latter does not apply if the present contract concerns the acquisition of financial instruments (e.g. securities, foreign currency or derivatives). If you wish to avoid a contractual commitment as far as possible, exercise your right of withdrawal and also withdraw from the loan agreement, if you are also entitled to a right of withdrawal in respect of that agreement.
General Notes
1) Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage.
2) Please do not return the goods to us freight collect.
3) Please note that points 1-2 above are not a precondition for the effective exercise of the right of withdrawal.
